The Patriots will not offer a contract tender to safety Bret Lockett, according to a source, and he'll become an unrestricted free agent at 4 p.m. Tuesday.

Lockett told NESN.com last June about a five-month affair with Kim Kardashian, who was engaged at the time to Nets forward Kris Humphries. Kardashian told news outlets she would sue Lockett due to the story, but a source told NESN.com on Monday that Kardashian never moved forward with the lawsuit.

Lockett was signed by the Browns as an undrafted free agent out of UCLA in 2009, but he was released after training camp and claimed off waivers by the Patriots. However, Lockett has been placed on injured reserve during all three of his seasons in New England.

Lockett, who also released a music video during the lockout, should still have a market in free agency. He's a great athlete who can contribute on special teams, though his health has been the greatest question mark.
