Eligibility: ChilleDD Out at Spring Training Sweepstakes (the “Sweepstakes”) is open only to legal U.S. residents currently residing in Massachusetts, New Hampshire, Maine, Vermont, Rhode Island and Connecticut. Employees of the New England Sports Network (NESN) (“Sponsor”) and Franchisees and employees, directors and officers of Dunkin’ Brands Inc. (“Promotional Prize Provider”) and any of their respective affiliates, parents, subsidiary companies, and advertising and Sweepstakes agencies (collectively with Twitter, the “Released Parties”), and members of the immediate families (spouses, parents, children, and siblings and their respective spouses, regardless of where they reside), and/or those living in the same household, of any of the foregoing, are not eligible. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and by the interpretations of these Official Rules by Sponsor, and by the decisions of Sponsor, which are final in all matters relating to the Sweepstakes.

Sweepstakes Period/Description: The Sweepstakes begins at 12:00:00 AM Eastern Time (“ET”) on February 23, 2013 and ends at 11:59:59 PM (ET) on March 10, 2013 (the “Sweepstakes Period”). After the Sweepstakes Period has ended, one (1) grand prize random drawing (the “Grand Prize Drawing”) will be held, from among all eligible Entries received throughout the entire Sweepstakes Period, in order to award one (1) grand prize (the “Grand Prize”).

How To Enter: There are two (2) possible methods of entry into this Sweepstakes. There is a limit of one (1) Entry per person, regardless of method of entry. All Entries must be in compliance with these Official Rules, including, without limitation, the Submission Guidelines detailed below. All Entries become the property of Sponsor and will not be returned. Multiple entrants are not permitted to share the same email address or account. Incomplete Entries, Entries generated by script, macro or other automated means, or Entries that do not fully comply with these Official Rules, including, without limitation, the Submission Guidelines, or which subvert the entry process, in the sole discretion of Sponsor, will not be eligible.

1. Via NESN.com: In order to receive one (1) Entry via this method, you must visit nesn.com/DunkinDonuts. to find the “ChilleDD Out at Spring Training Sweepstakes” Entry Page. Once at the Entry Page, follow the onscreen directions to provide all required information and complete the registration process (hereinafter an “Entry”).
2. Via Twitter: A Twitter account is required for this method of entry. If you don’t already have a Twitter account, visit http://www.twitter.com to create one. It is free to create an account. You must have a non-private Twitter account to enter this Sweepstakes. If you do not have a non-private account, there is no cost to create one at http://www.twitter.com. Once you have an account, you must become a follower of @NESN. It is free to follow @NESN on Twitter. If you have a Twitter account and are not already a follower of the @NESN account, then you may log onto Twitter using your Twitter user name and password, and then may become a follower of @NESN by going to http://www.twitter.com/NESN and clicking the “Follow” button. Please note that you must agree to comply with the Twitter Terms of Use and Privacy Policy in order to create your Twitter account. You must following @NESN throughout the Sweepstakes Period and for at least 60 days thereafter (for potential notification purposes) to participate in the Sweepstakes and be eligible to win. You may unfollow @NESN after the 60-day notification period. One (1) Entry via this method, tweet a message @NESN which contains: (a) the hash tag “#DunkinIcedSweeps”, (b) your full first and last name (hereinafter an Entry”). You can unfollow @NESN once the Sweepstakes Period has ended, but if you are selected as a potential winner, as detailed in section 9 below, you must be following @NESN in order to receive a Direct Message. By participating in this Sweepstakes, entrants will be subject to Sponsor’s Terms of Use (http://nesn.com/terms-of-use/) and Privacy Policy (http://nesn.com/privacy-policy/)where applicable. Further, use of Twitter to enter will also subject you to the Twitter Terms of Service (https://twitter.com/tos) and Privacy Policy (https://twitter.com/privacy).

Submission Guidelines: Each Entry that is submitted to the Sweepstakes via Twitter, must comply with the following Submission Guidelines. Any Entry submitted via Twitter that, in Sponsor’s sole and absolute discretion, violates these Official Rules or the Submission Guidelines below will be disqualified and/or will not be eligible to win a prize.

The entry MUST, in the sole discretion of Sponsor:

• Be written in English;

The entry must NOT, in the sole discretion of Sponsor:

• Contain material that violates or infringes upon another’s rights, including but not limited to privacy, publicity or intellectual property rights (including, without limitation, trademark or copyright infringement);
• Disparage Sponsor, Promotional Prize Provider or their products or services, Sponsor’s or Promotional Prize Provider’s competitors or their products or services, or any other person or party affiliated with the Sweepstakes;
• Contain company names, product names, brand names or trademarks other than those owned by Sponsor or Promotional Prize Provider, which entrant has a limited license to use for this Sweepstakes;
• Contains the names, likenesses, or other indicia identifying any celebrities and/or other public or private figure, living or dead;
• Contain material that is inappropriate, indecent, obscene, profane, hateful, tortious, defamatory, slanderous, controversial or libelous;
• Contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age;
• Contain material that is unlawful, in violation of or contrary to applicable laws or regulations; and/or
• Contain material in which the Released Parties do not wish to associate themselves with, in their sole discretion

Grand Prize/ARV: Grand Prize: There will be one (1) Grand Prize available to be awarded in this Sweepstakes. The Grand Prize Winner will receive a trip for themselves and one (1) guest, to Fort Meyers, Florida, on March 22, 2013 and returning on March 24, 2013. The Grand Prize Trip package will include (a) roundtrip airfare from Boston, MA to Ft. Myers, FL (b) one (1) room for two (2) nights, standard hotel accommodations (double occupancy), at a hotel of Sponsor’s selection; (c) opportunity to meet NESN’s announcers at the ballpark in Lee County on March 23, 2013 (d) one (1) $100 Dunkin’ Donuts card; ARV of the Grand Prize Package is Two Thousand Three Hundred Dollars ($2,300).

General Prize Conditions: The total ARV of all prizes available to be awarded in this Sweepstakes is Two Thousand Three Hundred Dollars ($2,300). In no event will Sponsor be responsible for awarding more than the stated number of prizes detailed herein. Dunkin’ Donuts Cards are subject to terms and conditions specified by Promotional Prize Provider. The prize restrictions/conditions stated herein are not all-inclusive. No transfer, substitution or cash equivalent for any prize, in whole or in part, will be permitted except at Sponsor’s sole discretion, and only then for a prize of greater or equal value determined by Sponsor. Prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose. Any and all guarantees and warrantees on merchandise prizes are subject to the manufacturer’s terms and conditions, and winners agree to look solely to said manufacturers for any such warranty or guarantee claim. Prize awards are subject to verification of eligibility and compliance with these terms of these Official Rules. Actual value of the Grand Prize depends on the time of travel, any airfare fluctuations and on current market conditions at time of prize fulfillment. All prize details are at Sponsor’s sole discretion. If the Grand Prize Winner chooses not to bring any guest(s), any difference between the stated ARV and the actual value, if any, will not be awarded. Travel arrangements will be made through the travel coordinator designated by Sponsor. One or more stopovers may be required on any air transportation. Sponsor will not replace any lost or stolen tickets, travel vouchers, certificates or similar items once they are in Grand Prize Winner’s possession. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. If any portion of the Grand Prize is unable to take place as planned, for any reason, the remaining components of the Grand Prize will be awarded and Sponsor’s obligation to the Grand Prize Winner will be fulfilled, and no other additional compensation or substitution will be provided. Grand Prize conditions may be added or modified by companies providing those portions of the prize. The Grand Prize restrictions/conditions stated herein are not all-inclusive and may be subject to additional restrictions/conditions, which may be stated in the Prize Claim Documents (as defined below) and/or prize travel documents. Sponsor shall not be liable for any loss or damage to baggage. Sponsor reserves the right to substitute ground transportation for air transportation if the Grand Prize Winner lives within a reasonable distance, at Sponsor’s discretion, to Ft. Myers, FL, and no compensation or substitution will be provided for difference in prize value. Grand Prize Winner and guest are solely responsible for obtaining all necessary and required travel documents. All airline tickets issued in conjunction with prize are not eligible for frequent flyer miles. Prize components cannot be used in conjunction with any other offers, and no portion may be separated except at Sponsor’s sole discretion. Grand Prize Winner and guest must have a valid U.S. photo identification and credit card in his/her name. Grand Prize travel does not include transportation to the major airport near the Grand Prize Winner’s residence, insurance, telephone charges, personal expenses, meals, rental car or other ground transportation expenses while in Florida, gratuities, incidental charges, taxes, or any other items not specifically described in these Official Rules, and all costs and expenses for any of the foregoing are the sole responsibility of the Grand Prize Winner. NESN will issue the winner a 1099 IRS tax form in January of the applicable tax year for the full retail value of the grand prize.

General Terms: Noncompliance with any of these Official Rules may result in disqualification. ANY VIOLATION OF THESE OFFICIAL RULES BY ENTRANTS OR WINNERS OR ANY BEHAVIOR BY A GRAND PRIZE WINNER OR GUEST THAT WILL BRING SUCH WINNER/GUEST, PROMOTIONAL PRIZE PROVIDER OR SPONSOR INTO DISREPUTE (IN SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH PRIZE WINNER’S/GUEST’S DISQUALIFICATION AND ALL PRIVILEGES AS WILL BE IMMEDIATELY TERMINATED. Released Parties assume no responsibility for incorrect or inaccurate entry information whether caused by any of the equipment or programming associated with or utilized in this Sweepstakes or by any human error, which may occur in the processing of the Entries in this Sweepstakes. Released Parties are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or other services, or providers, computer equipment, software, failure of any e-mail or players on account of technical problems or traffic congestion on the Internet or at any website, including or the Sweepstakes Application, or any combination thereof, including, without limitation, any injury or damage to participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Sweepstakes or for other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of Entries, the announcement of the prizes or in any Sweepstakes-related materials. If, for any reason, the Sweepstakes (or any portion thereof) is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes (or any portion thereof). Should the Sweepstakes (or any portion thereof) be terminated prior to the stated expiration date, notice will be posted on the Sweepstakes Application, or elsewhere as Sponsor sees fit, and any unawarded prizes will be awarded via random drawing from among all non-suspect, eligible entries received up until, or after (if applicable), the time of modification, cancellation or termination or in a manner that is fair and equitable as determined by Sponsor. All interpretations of these Official Rules and decisions by Sponsor are final. No software-generated, robotic, programmed, script, macro or other automated Entries are permitted. Sponsor reserves the right in their sole discretion to disqualify any individual (and void all associated Entries) they suspect or find: (i) to have used a software-generated, robotic, programmed, script, macro or other automated entry or any other means to subvert the entry process; (ii) to have tampered with the entry process or the operation of this Sweepstakes; (iii) to be acting in violation of these Official Rules; (iv) to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; or (v) to have provided inaccurate information on any legal documents submitted in connection with this Sweepstakes. CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR APPLICATION ASSOCIATED WITH THIS SWEEPSTAKES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. THE NEW YORK COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE SWEEPSTAKES AND THE LAWS OF THE STATE OF NEW YORK SHALL GOVERN THE SWEEPSTAKES. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THESE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS. Entrants agree that the Released Parties (a) shall not be responsible or liable for, and hereby release the Released Parties from, any claims, losses, damages or injuries of any kind (including death) resulting, in whole or in part, directly or indirectly, from participation in the Sweepstakes or any Sweepstakes-related activity, or from acceptance, receipt, possession and/or use/misuse or inability to use a prize, and (b) have not made any warranty, representation or guarantee, express or implied, in fact or in law, with respect to a prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. Released Parties shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience or irregularity that may be caused or contributed to (1) by any wrongful, negligent or unauthorized act or omission on the part of any of their agents, servants, employees or independent contractors; (2) by any wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of the Released Parties; or (3) by any other cause, condition or event whatsoever beyond the control of the Released Parties. Failure of Sponsor to enforce any provision herein shall not be deemed a waiver of such. Sponsor reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes. UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANTS HEREBY WAIVE ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR ANY OTHER DAMAGES WHATSOEVER. IN NO EVENT SHALL SPONSOR BE LIABLE TO ANY ENTRANT OR WINNER FOR DAMAGES THAT EXCEED THE VALUE OF THE PRIZE TO BE AWARDED TO THE INDIVIDUAL ENTRANT IN THIS SWEEPSTAKES.
