After an offseason filled with legal trouble in the NFL, two more players are facing a lawsuit in connection with a 2012 party.
San Francisco 49ers defensive end Aldon Smith and Tennessee Titans tight end Delanie Walker (who was Smith’s teammate in San Fran from 2011-12) are being sued by Ronndale Esporlas for illegally firing guns at a house party the two football stars were hosting in San Jose, Calif., on June 29, 2012,
Smith and Walker, who hosted the party, charged people $10 for entrance and $5 per drink throughout the night, according to court documents posted by NBC Bay Area. The lawsuit also alleges that both Smith and Walker were intoxicated and took to the balcony of the home and began shooting guns into the air. The suit adds that Walker eventually made his way down to the driveway and began shooting his gun into the air and even toward others at the party.
The shooting led to a group of people across the street firing back toward the party. Walker and Smith then returned fire, which left Esporlas in the crossfire of the shootout. Esporlas was shot in the leg twice during the incident, injuries that the lawsuit describes as “serious, catastrophic and permanent.”
Neither Smith nor Walker contacted any emergency personnel after the shooting, according to the lawsuit.
