Tom Brady’s 2016 Playing Status Could Depend On Justice Ruth Bader Ginsburg

New England Patriots fans, all hope apparently is not lost if Tom Brady’s petition for rehearing isn’t granted.

Brady must file the petition to rehear the Second Circuit judges’ decision to reinstate his four-game suspension over Deflategate by Monday. If it’s granted, Brady would be given a stay, and his suspension would be delayed. If it’s not, he has other options, according to ProFootball Talk.

Brady would likely ask the second circuit for a stay while his and the NFLPA’s lawyers prepare an appeal to the U.S. Supreme Court. If the stay, which would delay the suspension, is denied, Brady would request a stay to the lone Supreme Court justice assigned to the Second Circuit, Ruth Bader Ginsburg.

ProFootballTalk notes that’s “good news” for Brady, since Justice Ginsburg was appointed by a Democratic president.

ProFootballTalk summed it up nicely:

“Bottom line? Even if the Second Circuit refuses to take any further action and the U.S. Supreme Court later refuses to consider the case at all, Justice Ginsburg becomes the key to keeping Brady on the field through issuance of the Supreme Court’s decision not to take up the case, which if she issues the stay means that Brady likely wouldn’t be suspended until 2017 at the earliest.”
